The Information in section 1 may not be revised. A new agreement can be made through a second contract.

 

Section 2 – To be filled out and signed by the Artist

After reading the information provided in section 1 by the employer, I , Sabrina Allison, quote the price of this commission to be:

$______________________________ USD

Once I have received 50% of the payment listed above I shall complete the commission as described in Section 1 by the deadline listed above. Once the commission is complete I will send the employer a low resolution watermarked sample of the image. The employer must then send the remaining 50% of the payment in order to receive the full quality image.

If the employer, for some reason, is not happy with the end result of the commission, s/he may ask me to make small revisions or s/he may cancel the commission and not pay the remaining 50%. The employer will only be refunded his/her 50% if I fail to follow instruction as written above in Section 1 or I miss the deadline.

If the commission is for commercial use, then I only give the employer permission to use the image only how they have written in SECTION 1, #7 unless s/he gets written and signed permission from me. If the commission is for personal use, then the employer may not use the image for profit making purposes.

Section 3

 

    1)    I, _______________________________, the employer, agree to pay Sabrina Allison a 50% deposit of $______________ in order for her to start the commission, and once I am happy with the commission I shall pay her the other 50% of the commission.

    2)    I understand that the only way for a deposit to be refunded is if the artist fails to follow instructions given in Section 1 or she misses the assigned deadline.

    3)    I understand that If there is no deadline given for a commission, a deadline will be assigned one month from the date the commission deposit has been paid.

    4)    I understand that a commission will not be started until the deposit of at least 50% of the full price quoted by the artist of the commission has been paid, regardless of a deadline that has been set by the employer.

    5)    I understand that if I fail to pay the other 50% of the quoted price, I will not receive my commission.

    6)    I understand that if I have permission to use a commission for commercial use, I will only use it under the outlined terms, unless written permission from the artist has been given.

    7)    If I decide I would like to use the commission commercially, I must get written permission from the artist otherwise it is considered a breach in the contract.

    8)    I will not alter the image unless the alterations are included in section 1 or if I have received written permission from the artist.

    9)    If the commission is for personal use, I agree I will not resell the image for more than I paid for it.

    10) I understand that I am entitled to (4) redrawings of a commission that has been accepted by the artist. After 4 redrawings of a commission, the fourth redrawing of a commission is the final product.
